Drag and Drop without creating a subtask

I am trying to drag and drop tasks within a given smart list as a means of reordering,, each time I do the task gets moved to an existing task as a subtask this is very frustrating please advise

If the task underneath is highlighted yellow, then when you let go the task will become a subtask.

Try to drop it into the space that the other tasks leave when they move.
